POOL CUSTOMER TERMS AND CONDITIONS
Weekly service includes:
One weekly visit
Analyze water
Balance water with basic chemicals (only if you chose the weekly service including chemicals)
Brush tile, walls, steps, and sides
Empty all baskets and bags
Remove debris from pool surface with net
Vacuum pool/spa as needed
Clean up to 5’ of decking around pool
Check pool equipment
Verify that your automatic pool cleaner is operational
Regular backwash of filter as needed
Customer is responsible for:
Maintaining proper pool and spa water levels
Keep pool equipment operational
Report any notable issues with pool or pool equipment
Ensure access to the pool during scheduled maintenance times
Provide electricity required for the pool equipment
Keeping all gates, walkways, and other areas of pool needed for cleaning access in good condition.
EverClean is not responsible for:
Maintaining proper pool and spa water levels
Cleaning or removing debris or deposits from tile or finish that are not related to water chemistry issues
Removal of excess debris caused by acts of nature, lawn maintenance, etc.
Trimming trees or plants around the pool
Lost animals
Access:
Customers will ensure that our technician has full access to the pool and its pumps on scheduled service dates. A rescheduling fee will be charged if access is denied upon the technician’s arrival.
The customer will provide a safe and accessible work site for the service provider to perform the required services.
The customer shall grant access to outside water sources, electrical outlets, and any other necessary utilities or tools required to perform the services.
EverClean will be responsible for providing all equipment, tools, and materials necessary to perform the services.
Upon completion of the services, the service provider shall take necessary precautions to protect the property and remove all debris and equipment used during service, excluding the backwash material.
Opening and Closings:
Openings and closings are additional services that are provided at an additional charge. Depending on the condition of the pool at opening, additional service visits may be needed and there will be additional changes above those billed for opening stated below. Standard prices for these services are listed below. Customers must call to schedule an appointment for opening and closing.
Monthly rates are based on the size of the pool, if there is vegetation overhanging the pool, and other pool features.
Additional Fees:
There are standard maintenance items that may need to be replaced such as clock safety shield, PSI gauges, chlorinator and skimmer parts, lids, etc. Approval will be requested on all extra charges as needed and will be charged separately from your regular maintenance fee
The standard weekly service fee will be charged if there are inadequate water levels and/or there is no access at time of service.
This is a month to month agreement. At the time of your on-site estimate, it will be determined if a startup fee is needed for the initial pool maintenance service and will be billed at a one-time fee which will be provided at the time of on-site quote.
Additional service visits may be needed and billed extra above the normal service fee related to storms, severe algae problems, small animal removal, and debris removal caused by another company.
Additional Charges:
Return trips due to leaves or debris from your lawn service.
Extra visits during heavy foliage season (spring/fall).
Other expenses not included in your monthly service fee such as filter cleaning, equipment repairs, opening or closing the pool.
Any additional service requested by the client beyond the scope of the standard pool service contract will be itemized in the invoice and billed separately and due upon receipt.
Filter cleanings.
Payment:
It will be required to have a customer's credit card on file for automatic payment processing once per month.
First payment will be processed upon startup service. Recurring charges will begin the following month as pre-payment for services to follow.
A late fee will be assessed if the credit card information changes or expires, not allowing the payment to process. Any late payments will bear an interest rate of 1.5% per month calculated on the amount owed from the date on which it became due and payable until paid.
Inclement weather / holidays:
In the event that your cleaning falls on a holiday or during inclement weather, we will make every effort possible to check the equipment, baskets, chemicals, and vacuum the pool. Your visit may be skipped if road conditions do not allow for safe travel due to winter weather conditions.
Pools will receive cleaning of baskets and bags and chemical service only during heavy rain or thunder/lighting storms.
We will be closed and will not service the following dates:
New years day
Independence day
Labor day
Day of and day after Thanksgiving
Day of and day after Christmas
There will not be any credits on the holidays with no service. We do not charge extra for months with 5 weeks in anticipation of skipped service due to holidays.
Liability:
EverClean will not be liable for any damage or loss caused by improper maintenance or handling of the pool by the customer or third parties. EverClean shall maintain general liability insurance to cover any damages resulting from the services provided.
Dispute Resolution:
Any disputes regarding invoices or charges must be communicated in writing to the Service Provider within 15 days of receipt of invoice. Both parties agree to work in god faith to resolve any disputes promptly. In the event of failure to resolve the dispute by amicable settlement, the parties shall resolve the matter by litigation. The losing party shall therefore pay the prevailing party any and all litigation costs other than the award of the dispute. If you have any complaints or concerns regarding frequency or completeness of service, you must notify via email EverClean within 24 hours after the service occurred or was scheduled to have occurred.
Cancellation:
Either party may cancel this agreement with a 30 day written notice. In the event of cancellation, the customer agrees to pay for all services rendered up to the termination date.
Disclaimer:
EverClean will not be responsible for any damage to property due to acts of nature, fire, vandalism, misuse, or abuse.
EverClean is not responsible for the performance of any chemicals it does not personally use at time of service.
Customers should be aware of normal deterioration of equipment that occurs over time due to exposure to chemicals and sunlight. Due to these factors, EverClean recommends other annual services (annual tune-up of equipment, filter cleanings, etc.) above normal maintenance.
The customer is responsible for maintaining the correct water level and keeping trees and plants trimmed away from the pool/spa dn equipment and maintaining equipment.
EverClean is not responsible for any damages or deterioration caused by failure of customer to perform other services recommended by EverClean or by failure of customer to properly maintain pool and equipment between visits.
Efforts will be made to maintain consistency by performing maintenance on the same day each week, but alternate service days may be necessary based on availability.
